These are Terms of Use on which you may use zable.co.uk, its subsections and any of its microsites (the Website). Please read these carefully before you start to use the Website. By using our Website you indicate that you accept these Terms of Use and that you agree to abide by them. If you do not agree to these Terms of Use, please refrain from using our Website.

Please note that you should always think very carefully before you commit to taking out credit. Before proceeding with an application, please make sure you read the pre-contract credit information document, the adequate explanations document, and the credit agreement provided to you. Please also seek advice if you are unclear about any of the terms or information contained in these documents.

1. Information about us

zable.co.uk is a website operated by Lendable Ltd (we, us). We are a Private Limited Company, registered in the United Kingdom under company number 08828186 and have our registered office at Telephone House, 69-77 Paul St, London, EC2A 4NW.

2. Other applicable terms

These Terms of Use refer to our privacy policy, which also applies to your use of our Website. By using our Website, you consent to the terms and conditions of our privacy policy and you warrant that all data provided by you is accurate.

3. Accessing our Website

Access to our Website is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our Website without notice (see below). We do not guarantee that our Website, or any content on it, will always be available or be uninterrupted. We will not be liable if for any reason our Website is unavailable at any time or for any period. You are responsible for making all arrangements necessary for you to have access to our Website.

Subject to your compliance with these Terms of Use, we grant you permission to use our Website, provided that: (a) use of our Website is permitted is solely for your personal use, and you are not permitted to resell or charge others for use of or access to our Website, or to use our Website in any other manner inconsistent with these Terms of Use; (b) you will not duplicate, transfer, give access to, copy or distribute any part of our Website in any medium without our prior written authorisation; and (c) you will otherwise comply with the terms and conditions of these Terms of Use and our Privacy Policy.

You confirm that you are over 18 years of age and are fully competent to enter into and comply with these Terms of Use and our privacy policy.

4. Eligibility and Fees

To subscribe to the lending services we provide through our Website, you must meet our eligibility criteria.

To be eligible you must:

  • be an individual residing in the UK;

  • be at least 18 years old; and

  • have a current account at a UK bank or building society.

If you meet our eligibility criteria set out above, you will be able to set up a credit card account with our Website and may apply for an account through our Website. As part of our account approval process we may:

  • make identity, fraud and credit checks;

  • obtain a credit rating for you from the credit reference agency we use; and

  • carry out anti-money laundering checks on you.

All credit card applications are subject to our approval and we can decline an application for any reason. If we approve your application, you will need to enter into a credit agreement with us. We will not create a credit card account until you enter into such agreement.

5. Our site changes regularly

We aim to update our Website regularly, and (provided such changes do not adversely affect you) may change the content at any time without notice by posting such changes on our Website. If the need arises, we may suspend access to our Website, or close it indefinitely without notice. Any of the material on our Website may be out of date at any given time, and we are under no obligation to update such material. We do not guarantee that our site, or any content on it, will be free from errors or omissions.

6. Termination of your account

You can give us notice at any time that you wish to end this agreement via the Zable App or by writing to us using the contact details given at the end of your credit agreement and by paying off your balance in full, or by sending an e-mail to cards@zable.co.uk. You can make payment of the amount that you owe us via the Zable App or by calling us to make payment of that amount on 020 3322 9128.

Following notice of termination of your account you will no longer be able to access your account. However, we and our collections agency will continue to maintain records regarding you to the extent that we are required by law to do so.

We may terminate your account if you have lied to us, seriously or repeatedly breached these Terms of Use, die, become bankrupt or make a voluntary arrangement with anyone you owe money to.

We may either terminate or suspend your account immediately and without notice if we are aware or reasonably suspect that you are engaged in, or may be the victim of, any fraudulent activity. We will then notify you of any such termination or suspension as soon as is reasonably practicable, to the extent we are permitted to do so by applicable law.

7. Our liability

Except as expressly stated in these Terms of Use, we do not give any representations, warranties or undertakings in relation to our Website.

To the extent permitted by law, we, other members of our group of companies and third parties connected to us hereby expressly exclude our liability under or in connection with these Terms of Use and/or your use of our Website whether in contract, tort (including negligence) or otherwise. This does not apply to the types of loss set out below.

Nothing in these Terms of Use shall limit or exclude our liability for:

  • death or personal injury resulting from our negligence;

  • fraud or fraudulent misrepresentation; or

  • any other liability that cannot be excluded or limited by English law.

8. Intellectual property rights

We or our licensees are the owner or the licensee of all intellectual property rights in our Website, and in the material published on it. You must not use any part of the materials on our Website for commercial purposes without obtaining a licence to do so from us or our licensors.

9. Reliance on information posted

The material displayed on our Website is provided without any guarantees, conditions or warranties as to its accuracy. Whenever you make use of a feature that allows you to upload content to our Website, or to make contact with other users of our Website, you must comply with the content standards which we upload to our Website from time to time.

You warrant that any such contribution complies with those standards, and you will be liable to us and indemnify us for any breach of this warranty. If you are a consumer user, this means you will be responsible for any loss or damage we suffer as a result of your breach of warranty.

The English courts will have non-exclusive jurisdiction over any claim arising from, or related to, a visit to our Website, although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country. These Terms of Use and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.

These Terms of Use supplement any existing terms and conditions between you and Lendable Ltd, and together these constitute the whole agreement between you and Lendable Ltd. To the extent that there is any inconsistency between these Terms of Use and your existing terms and conditions, then these Terms of Use shall prevail in respect of our Website.

16. Variations

We may revise these Terms of Use at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we may have made as they are binding on you. Some of the provisions contained in these Terms of Use may also be superseded by provisions or notices published elsewhere on our Website.
